1- Purpose and identification

The present document ("General Sales Conditions" or "GSC") defines the conditions applicable to sales concluded between, on the one hand, persons (private individuals or professionals) wishing to make a purchase via the RUCHAUD website, hereinafter referred to as "the customer" and, on the other hand, the company ETS RUCHAUD, a simplified joint stock company with a capital of 200,000 euros whose registered office is located at : 9 rue Michel Breton - 85150 Les Achards, registered with the RCS of La Roche sur Yon under number 302 260 211 hereinafter referred to as "the seller" or "RUCHAUD".

Any sale implies acceptance by the Customer of these general terms and conditions, to which the Customer may not oppose any waiver not previously and expressly accepted by the seller.

2- Products

The site offers two types of products:

  • Made-to-measure products, in particular the cutting of foam, mattresses or cushions, designed according to the customer's specifications (dimensions, density, shape, fabric, etc.);
  • Standard products (accessories or prefabricated products), sold as is without customisation.

The essential characteristics of each product are described on the pages of the site.
The offers presented by RUCHAUD are only valid while stocks last.
Made-to-measure cut-outs are produced with a dimensional tolerance of ±5 % in accordance with professional practice. This tolerance also applies to thickness, density and textiles. These variations do not constitute grounds for refusal, return or request for compensation.

3- How to order

The customer is responsible for the accuracy of the information provided at the time of ordering, in particular the measurements and specifications for made-to-measure products.

The order becomes firm and definitive once payment has been confirmed.
The customer acknowledges that validation of the order constitutes a firm and definitive commitment, including for specifications entered by the customer. RUCHAUD does not carry out any consistency checks.

As a user, you can consult the site at any time, download in PDF format or print out the current "General Terms and Conditions of Sale" which you will find at the bottom of each page of the RUCHAUD Site. These General Terms and Conditions of Sale may be subject to change. The applicable conditions are those in force on the www.ruchaud.com site on the date the order is placed.

The seller reserves the right not to fulfil a customer order if the customer fails to comply with the provisions of these General Terms and Conditions of Sale or applicable legislation.

4- Prices and payment

Prices are given in euros, inclusive of all taxes.
Payment is made when the order is placed by credit card on the website.
The full price must be paid when the order is placed. At no time may the sums paid be considered as deposits or advance payments.
The order will only be processed once payment has been confirmed.
RUCHAUD reserves the right to suspend all order processing and deliveries in the event of refusal to authorise payment by bank card by officially accredited organisations.

5- Preparation and manufacture

Manufacturing and/or preparation times are as follows:

  • Made-to-measure mattresses: 15 to 20 working days.
  • Foam cutting: 5 to 7 working days.
  • Standard products in stock: 2 to 3 working days.

The order will be executed within 2 working days from the day following the day on which the consumer placed the order. Our delivery times are given for information only and are not binding. In the event of unavailability of the product ordered, in particular due to our suppliers, the consumer will be informed as soon as possible and will have the option of cancelling the order.

6- Delivery

To date, only click and collect at the Ruchaud workshop is possible. Customers should go to the visitor reception desk at 9 rue Michel Breton in Les Achards (85 150). The reception is open from 8.30am to 12.30pm and from 1.30pm to 5pm.

7- Right of withdrawal

Made-to-measure products

In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to products "made to the consumer's specifications or clearly personalised".
Therefore, no cancellation, return or refund can be demanded for custom-made products, unless there is a proven defect or non-conformity.
By validating his/her order, the customer expressly acknowledges that he/she loses his/her right of withdrawal for made-to-measure products.

Standard products

For non-personalised products, the customer has a period of 14 calendar days from receipt to exercise their right of withdrawal, without justification or penalty.
This period runs from the day of delivery of the customer's order. If this period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

A standard withdrawal form is available on request and can be requested by e-mail from : info@ruchaud.com

Products must be returned in their original packaging, at the customer's expense, and in a condition suitable for resale. Reimbursement will be made by crediting the customer's bank account within 14 days of receipt of the returned products.

Only products returned in their entirety, in their complete and undamaged original packaging and in perfect condition for resale will be accepted. Any product that has been damaged or whose original packaging has been damaged will not be refunded or exchanged.

8- Conformity - Guarantees

The products are covered by legal guarantees:

  • Legal guarantee of conformity (articles L217-3 to L217-20 of the French Consumer Code),
  • Guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code).

In the event of non-conformity or hidden defect, the customer may request replacement, repair or reimbursement in accordance with the terms and conditions laid down by law.

9- Secure transactions

Your bank details will be encrypted so that they cannot be read. They will be recorded directly on the secure payment server of our payment service provider. This means that no banking information concerning you will pass through the RUCHAUD site.
You can pay online in complete confidence by entering your bank card number, expiry date and the security code on the back of your card in the spaces provided. At the time of payment, your bank will check the identity of the cardholder before validating the transaction.
RUCHAUD has no access whatsoever to these credit card details. This is why you are asked for them again each time you make a new transaction on our site.

In particular, the customer is invited to ensure that the payment is secure, by checking in the browser address bar that the address begins with "https".

10- Liability

The company cannot be held responsible:

  • errors in dimensions or specifications supplied by the customer,
  • inappropriate use of the products,
  • delays due to exceptional circumstances or force majeure as defined by French case law: war, strike, pandemic, supplier shortages, fire, flood, etc.

11- Personal data

RUCHAUD undertakes to comply with the regulations in force relating to the protection of personal data, and in particular the General Data Protection Regulation (RGPD).

Purpose of processing:
The data collected when the order is placed (name, address, email address, telephone number, etc.) is necessary to process the order:

  • order management,
  • billing,
  • on delivery,
  • customer service management.

Conservation :

Data is kept for as long as is necessary to fulfil the contract, then archived in accordance with accounting and tax obligations (10 years).

Customer rights :

In accordance with Articles 15 to 22 of the RGPD, the customer has the following rights:

  • right of access to its data,
  • right of rectification,
  • right to erasure ("right to be forgotten"),
  • the right to restrict processing,
  • right of objection,
  • right to portability.

A response will be provided within 30 days.
Data is not sold or transferred to third parties without consent, unless required by law.

12- Intellectual property

All content on the site (text, images, graphics, logos, etc.) is the exclusive property of RUCHAUD or its partners.
Any unauthorised reproduction, distribution or use is prohibited.

13- Duration

The present conditions apply for the entire duration of the online services offered by RUCHAUD.

14- Settlement of disputes

These GCS are governed by French law.
In the event of a dispute, an amicable solution will be sought.
Failing this, the competent courts will be those of the company's registered office or, for consumers, those provided for in the Consumer Code.
